Officers watched as a male forced the gates to enter into the Powell Street Station. Officers detained the male and a records/warrant check revealed the male had a $75,000 warrant for theft issued by SFPD. The male was placed under arrest on the warrant. The male was searched, incident to arrest, and officers discovered the male was in possession of a concealed weapon and stolen property. The male invoked his Miranda rights. Officers contacted the victim and learned his vehicle was burglarized in San Francisco. SFPD was contacted and advised. The male was cited for fare evasion and was booked for possession of a concealed weapon and possession of stolen property into the San Francisco County Jail. Detectives were advised of the arrest. A sergeant responded to approve the arrest.

A male victim entered the station with a gunshot wound to the abdomen. Witnesses reported hearing several gunshots in the area. Officers responded but did not locate any suspects in the area. The victim was transported to Eden Medical Center for treatment. The victim's wounds did not appear to be life threatening. The victim was not cooperative with investigating officers and witnesses provided conflicting descriptions of possible suspects. Officers located the crime scene in the station bus zone. The on-call detective responded to coordinate the investigation. Hayward PD and ACSO assisted with area searches and collection of video evidence. TSOC notified. The station was closed for about 70 minutes as a result of this incident. Trains ran through, but did not pick up or discharge passengers. The investigation is ongoing.

North Berkeley - 1406-4540

A detective, conducting surveillance in response to two recent armed robberies at the station (one completed robbery on 6/18 - 1406-2893 and one attempted robbery on 6/25 - 1406-4148), noticed a male suspect loitering near the parking lot who matched the description of the suspect. Responding officers made contact with the male nearby. While tracing his steps, officers located a replica handgun nearby. The victim of the completed robbery responded to the scene and identified the male as the same person who had robbed him at gunpoint on 6/18. The juvenile suspect was transported by detectives and interviewed. He confessed to committing both of the reported robberies and was booked into juvenile hall for one count of armed robbery and one count of attempted armed robbery. He was also issued a prohibition order.

A female victim called to report that another female was swinging a metal fence pole at her. An officer arrived and made contact with both parties. The victim and suspect, who are both homeless and known to each other, were involved in a dispute over the portable restrooms, which are located in the parking lot. The suspect claimed that the victim had urinated on her and she became irate. The suspect found a metal pole in the area and swung it at the victim. The suspect was unable to hit the victim and neither party was injured. The suspect, the victim and witnesses were interviewed by responding officers. The suspect was issued a prohibition order and booked at the Berkeley City Jail for attempted assault with a deadly weapon.

Two groups of juveniles became involved in a dispute in the bus zone. Members of both groups exchanged gunfire from the bus zone and an adjacent city street. There were no apparent injuries as a result of the gunfire and there was no impact on service. The bus zone was closed while the crime scene was investigated and evidence was recovered. Video evidence was recovered from station cameras and AC Transit bus video. The investigation is ongoing with the assistance of Hayward PD and the Alameda County Sheriff. TSOC notified.

West Oakland - 1406-1063

While walking on Oak Street, between 7th and 8th Streets, a male victim heard two gunshots, but was unsure from which direction they originated. Shortly after hearing the gunshots, the victim saw a male suspect jogging toward him from the area of 8th and Oak Streets. The suspect then confronted the victim and demanded his cell phone and wallet, while holding a black semi-automatic handgun alongside his right leg. The victim gave the suspect the items and the suspect fled eastbound on Oak St., toward 7th St. Responding officers searched for the suspect, but were unable to locate him. In addition to the wallet and cell phone, the victim reported the suspect took nearly $20 in cash and a credit card. The victim was not injured during the robbery. The suspect is further described as: 25-30 years of age; 5’8 to 5’9 tall; thin build; wearing black clothing and long braided hair. An officer investigated the case.

While at the station, BART officers were contacted by San Francisco Police officers who were searching for four subjects. One of the subjects was said to be armed with a handgun which he had reportedly brandished at another subject on city streets. The San Francisco officers then detained a subject on platform level and discovered he was in possession of an air-soft pistol. San Francisco officers took custody of the subject and handled the entire investigation. A sergeant responded to the station, but there was no use of force by BART officers.

An officer stopped three male suspects for fare evasion at the 19th Street BART Station. The males used the elevator to fare evade from the free area into the paid area. The officer detained all three but one suspect turned his back to the officer and stuck his hands inside his waistband. The officer attempted to place the male into a control hold but the male resisted. The officer used force to take the male to the ground where he was restrained and was placed into handcuffs. The male was searched and was found to be in possession of narcotics and a concealed knife. A records/warrant check showed the male was on parole but was clear of warrants. The male was placed under arrest for fare evasion, possession of narcotics, concealed weapon, and a parole violation. A sergeant responded to approve the arrest and conduct a use of force report. The male was booked into the Glenn Dyer Jail.

The station agent reported that two males were involved in a dispute near the fare gates. One of the males pulled a knife and brandished it at the other man, who retreated into the bus zone. The man with the knife entered the station and went to platform #2. Responding officers located the suspect on the platform. The suspect was initially compliant, but suddenly lunged toward his waistband and he was taken into custody by means of a Taser activation. A knife was recovered from the area where the suspect was reaching. The victim placed the suspect under citizen's arrest for brandishing a knife. After being medically cleared, the suspect was booked at the Martinez Detention Facility for brandishing a knife and resisting arrest.

An officer on patrol discovered a juvenile male in the bus zone with a gunshot wound to his foot. The victim claimed that he was shot on the pedestrian bridge connecting the station with Bay Fair Mall. Officers located evidence on the bridge where it connects with the station parking lot. The victim was transported to Kaiser Hospital in Hayward for treatment of a non-life threatening wound. The victim ultimately admitted that he shot himself in the foot. he claimed that another male attempted to sell him a handgun and that while he was examining the gun, he accidentally shot himself. The other male took the gun and fled away from the station. The victim claimed he did not know the other male. The on-call detective responded and the victim was ultimately issued a juvenile citation for being a minor in possession of a handgun and for being a probationer in possession of a handgun. TSOC was notified. There were no other injuries and no impact on service.

An argument between two males resulted in one of the men threatening the other with a knife. The victim defended himself by holding up a milk crate until the arrival of officers. There were no injuries. The suspect was placed under arrest for brandishing a weapon. The suspect was also booked for having an active stay away order from all BART stations and an outstanding no-bail arrest warrant out of Contra Costa County for violation of post release community supervision. A sergeant arrived at the scene to approve the arrest, and the suspect was issued a 30 day BART prohibition order.

Officers responded to a reported of a male juvenile in possession of gun in front of the station. The juvenile did not appear to be nervous and was not threatening anyone with the weapon. Union City Police arrived at the scene, recovered a gun from the juvenile without incident, and then turned the case over to BART Police. The juvenile, who had no prior history of violence, was placed under arrest for possession of a firearm. A sergeant arrived at the scene to approve the arrest and interview the juvenile. TSOC notified.

 Attempted Grand Theft from Person/Possession of a Concealed Firearm (Arrest)

A witness reported that three male suspects tried to take a bag from a patron while on board a Richmond bound train that was just about to depart from the station. Patrons on board the train reportedly intervened and were able to recover the victim’s bag as all three suspects ran off the train. The victim remained on the train and it was unknown at this point if the victim wanted to pursue a complaint. Officers arrived and detained 3 possible juvenile suspects in the concourse area of the station. During the detention, the officers recovered a concealed, loaded firearm on one of the suspects. One of the three suspects fled on foot shortly after. A foot pursuit ensued after the third suspect but he was able to escape. The two other suspects were ultimately handcuffed and detained. The officers were able to contact the witness to the incident and had them respond to conduct an in-field show up. The witness was unable to positively identify either party as the ones responsible for committing the theft. The suspect with the firearm was interviewed by a sergeant (former detective) and is to be booked into the Alameda County Juvenile Hall for being in possession of a concealed and loaded firearm. The other suspect was released to his parent. The on-call detective was advised of the incident. TSOC was notified.

Nursing staff from Sutter Delta Hospital in Antioch called to report that they had a male victim in the emergency room with a minor wound to his foot. The victim claimed he sustained the wound on 5/9/14, at about 1000 hours, at the Concord Station. The victim claimed he was involved in a fight with another male in the bus zone. The victim heard a gunshot, but thought nothing of it. When he returned home, he discovered a wound to his foot. The victim was uncooperative and left the hospital before an officer could speak to him in person. He told an officer on the phone that he would not provide any details beyond what had already been reported by the hospital staff. Nursing staff reported that the victim's wound was similar to a BB gun puncture wound. An officer responded to collect a metal fragment taken from the victim's wound. There were no reports of a fight, gunshots, or other disturbances during the time the victim claimed he was injured. There is some question as to whether the victim's injuries occurred where and how he claimed. Antioch PD was contacted and briefed on the incident in the event that it actually occurred in their city. The incident has been forwarded to detectives for follow-up investigation.

A male victim was stabbed in the arm while on board the Fremont bound train approaching Lake Merritt Station. The victim got off the train and collapsed on the platform, where patrons rendered first aid. The suspect remained on board the train. The suspect was described only as a short black male with a dark complexion, a short afro haircut and in possession of a silver bike. A bald Hispanic male may have been with the suspect. The train was intercepted and searched at San Leandro Station. Several possible suspects were detained, but witnesses could not identify any of the detainees as being involved in the crime, so they were released after being identified. The victim was transported to Highland Hospital for treatment of a significant, but not life threatening wound. The on-call detective was notified. The incident train was taken out of service. TSOC notified.

While on patrol, an officer conducted a consensual contact on a male (whom he knew from previous contacts as being on probation) and female subject. A wants check revealed that both the male and female parties had active stay away orders from each other. The male party was also on searchable probation. The officer searched the male party and found two daggers on his person. The female party was searched and found to have a suspected “meth” pipe on her person with a useable amount of methamphetamines in it, as well as a dagger. Both parties were arrested and booked into the Hayward Police Facility for violating their active court orders, for possession of a concealed weapon (dagger), and for probation violation. The female suspect had the added charges of possession of narcotics paraphernalia and possession of methamphetamines. TSOC was notified.

An off-duty station agent reported that a male suspect was walking through the Millbrae bound train, holding a large knife in his hand. The suspect was described as a white male in his mid-20's, with short hair, wearing a black jacket and blue jeans. The train was held at Pleasant Hill Station with doors open. BART officers, along with Contra Costa County Sheriff's deputies, responded to the call. Officers located a suspect matching the description provided by the reporting party and detained him at the rear of the train. The suspect claimed he was looking for someone who he believed had stolen some of his property. The reporting party confirmed that the suspect had brandished the knife at him while walking through the train, so the suspect was arrested for brandishing a weapon. The knife in the suspect's possession qualified as a dirk/dagger. The suspect was issued a prohibition order and was later booked at the Martinez Detention Facility for brandishing a weapon and possession of a dirk/dagger. TSOC was notified. The Millbrae train was held about 11 minutes as a result of this incident. There were no injuries.

An anonymous patron reported to a station agent that a male had entered the station with a handgun tucked inside his waistband. Trains were held out and officers responded to the station. The male walked up to platform #2 and the agent lost sight of him. Officers arrived, searched the station and found the male on the concourse level of the station. The male was detained and a search revealed that he was not in possession of a firearm. However, the male did not have a ticket and admitted to fare evading into the station. Trains were released and service resumed. The male was cited for fare evasion and was released. Trains were delayed 14 minutes.

Domestic Violence/Criminal Threats

Daly City PD requested that we respond to a residence in their city to take over a domestic violence case. Officers responded and located the victim of a domestic violence incident in the residence. The investigation determined that a married couple rode a train to Daly City earlier in the evening. While on the train, the husband threatened the victim with a box cutter. Once at the station, the victim attempted to walk away from the husband and he pulled her hair and bit her on the hand. The couple took a taxi to the home of the victim's uncle and she jumped out and ran inside to call the police. Daly City PD detained the husband outside the residence. Based on the investigation, the husband was arrested for domestic violence and criminal threats. The suspect was booked at the San Mateo County Jail. An EPO was obtained for the victim and she was provided with domestic violence resources. THe victim did not require medical attention.

A male victim reported that he was robbed at gunpoint while he was seated in his car in the lower parking lot. Two Hispanic males, aged 18-19 years, drove up behind the victim in a dark green, late 90's model Toyota or Nissan 4-door sedan. The suspect driver walked up to the victim and demanded money and the victim's cell phone. The victim surrendered some cash, but the suspect grabbed the victim's wallet and a struggle ensued. The suspect then brandished a black semi-automatic handgun and took the victim's wallet and cell phone. A second suspect opened the victim's passenger door and stole a briefcase containing cash and other personal items. Both suspects then fled in the vehicle. The armed suspect was described as being 5'6" tall, with a light complexion and a ponytail, wearing a long black tee shirt. Responding officers were unable to locate the suspects or their vehicle in the area. Attempts to track the victim's cell phone proved unsuccessful. The victim suffered bruises to his face. All suspect information was shared with neighboring agencies.

Two BART Officers on routine patrol contacted the suspect on a welfare check. The officers observed three throwing knives that were attached to the suspect's belt, and in plain sight. The officers detained the suspect and conducted a search of his person for additional weapons. Officers located a throwing hatchet and a brass knuckle knife secured in a shoulder holster which was concealed under the suspect's arm. The suspect was placed under arrest for possession of the dangerous weapons. A records check of the suspect revealed several warrants held by the San Francisco PD for various SF Muni Code violations, totaling $3,000. The zone sergeant responded to approve the arrest and debrief the suspect. The suspect was booked into the SF County Jail on two counts of possession of a dangerous weapon. TSOC and NCRIC were notified.

BART officers responded to the station on a report, by a Hayward Police school resource officer, of a potential fight involving juveniles. As one of the responding officers neared the station, he came upon a group of juveniles who pointed to a female suspect as she chased after another subject. The officer attempted to restrain the suspect, but she pulled away from his grasp. Shortly thereafter, a second officer arrived on scene and the two officers managed to physically restrain the suspect. During this time the suspect held a knife in her hand, but the officers safely disarmed her and placed her in handcuffs. As the officers escorted the suspect to a nearby patrol car, however, she kicked both officers about their lower bodies before they managed to place her in the car without further incident, or injury to either officer. A sergeant responded to approve the arrest, debrief the suspect and perform the use of force investigation. Hayward officers also responded in order to investigate the initial battery report as it was determined that crime occurred in their jurisdiction; the subject initially pursued by the suspect was not located at the scene. As a result of being involved in a fight with another subject, the suspect sustained a tooth injury and was transported to a hospital for medical attention, before being booked into juvenile hall for possessing a dirk/dagger and battery on a peace officer; she was also issued a prohibition order.

Officers responded to the Richmond Station regarding a suspect that hit a victim in the head with an unknown object. The incident occurred on 2/3/14 at 1950 hours but the victim reported the suspect was now at the station. Officers contacted the suspect at the station and he attempted to flee. The suspect fought with the officers and force was used to take him into custody. A lieutenant responded to complete a Use of Force Investigation. The male was booked on the listed charges at the Martinez Detention Center.
