 Public Intoxication/Resisting Arrest/Psychological Evaluation

Fruitvale - 1312-3974

An officer was detailed to the station in order to search for, and perform a welfare check upon, a female who was earlier reported as crying aboard a Dublin bound train while also stating she had been raped.  During the search of the station, the officer located a female passed - out in the (paid) concourse area.  The female was awakened, stood upright, but then staggered toward the station agent’s booth.  Based upon the objective symptoms of alcohol intoxication the subject exhibited, the officer determined the subject was unable to care for her own safety and proceeded to place her under arrest.  The subject, however, physically resisted the officer and a struggle ensued.  Subsequently, the officer was able to take the subject into custody by using force and a sergeant responded to the scene.  While in custody, the subject claimed to have been raped by an unknown person, but when asked by officers to provide further information regarding the claim she refused.  She did state, however, that she was pregnant.  Based upon her level of intoxication, coupled with her pregnancy claim, the subject was transported to Highland Hospital for medical treatment.  While there, the subject made suicidal statements and was placed on a psychiatric hold as well.  Hospital staff advised that a trained rape advocate would attempt to obtain further information from the subject once she is psychologically cleared.  In the meantime, provided no further information regarding the rape claim is obtained, a police hold has been placed on the subject for public intoxication and resisting arrest.  The officer and the subject were not injured during the struggle, and the sergeant performed the use of force investigation.
