 Domestic Violence Arrest (Prohibition Order)

A 911 caller reported that a male and female were involved in a physical fight in the bus zone on the MacDonald Avenue side of the station.  The suspect, described as a black male, about 50 years old, wearing a white shirt and light green pants, reportedly punched the victim several times, knocking her to the ground.  The suspect continued to punch the victim on the ground.  When the victim attempted to use her cell phone to call the police, the suspect smashed the phone.  The suspect attempted to take a taxi from the station, but none of the taxi drivers would accept him.  The suspect walked away from the station, but was detained a short distance away by Richmond PD.  The victim positively identified the suspect, who is her boyfriend.  The victim suffered cuts and bruises to her face and was transported to the hospital for treatment.  The suspect was arrested for domestic violence and for the destruction of the victim's cell phone.  An emergency protective order was obtained for the victim and the suspect was issued a prohibition order.  The on-call detective responded to interview the suspect, but he refused to provide a statement.  The suspect was booked at the Martinez Detention Facility.

An officer contacted an adult male for fare evasion.  The male tried to walk away from the officer.  When the officer tried to detail the male, he punched the officer.  The officer was able to wrestle the suspect to the ground and was eventually able to take the suspect into custody with the assistance of arriving OPD officers.  The suspect was transported to the hospital for a complaint of pain and will be booked into the Glenn Dyer Jail for fare evasion, battery on an officer, resisting arrest and for threatening the officer.  The officer did not require medical attention.   The suspect was issued a prohibition order.

A male and female were engaged in a physical fight in the parking lot.  Officers detained the two subjects in the pedestrian tunnel and determined that the two were in a dating relationship.  The female subject was determined to be the aggressor and she was arrested for misdemeanor domestic violence.  The male victim was not injured.  The victim declined an Emergency Protective Order.  A search of the female incident to arrest revealed a crack pipe on her person.  The female, who is pregnant, was booked at Santa Rita Jail after being medically cleared at the hospital.  The female was issued a prohibition order.

A female patron reported that a subject inappropriately touched her on her leg while they were on board a train.  An officer responded and located the subject in question.  The victim placed the suspect under citizen’s arrest for battery, and he (the suspect) was issued a citation and released.  The suspect was also issued a prohibition order.

A victim was punched by a male as a result of accidentally bumping into him with a bicycle while on the platform. The victim accidentally bumped into the suspect, and even though the victim excused himself, the suspect punched the man in the face. Both parties engaged in a wrestling match until an officer arrived. The suspect was cited for battery and issued a 30 day BART prohibition order.

Officers responded to a report of a male and female fighting in the free area near the agent's booth.  Responding officers contacted the victim and learned that the suspect was her former boyfriend.  The two had gotten into an argument over possession of a cell phone and the male began to physically batter the female.  The victim defended herself and the male boarded a bus, which officers stopped near the station.  The male suspect was off-boarded from the bus and postively identified by the victim.  The male was arrested for misdemeanor domestic violence and issued a prohibition order.  An Emergency Protective Order was obtained for the victim.  The male was booked at Santa Rita Jail.  Neither party was injured.

An officer responded to intercept a train for a report of a fight. A victim (a BART employee) said a man punched her in the face after she tried to verbally diffuse an argument between the suspect and another person. The victim positively identified a suspect who was detained at the scene, and placed him under citizen’s arrest for battery. The suspect was placed under arrest for battery and was issued a 30 day BART prohibition order. There were no injuries. A sergeant arrived at the scene to approve the arrest and debrief the suspect.

While sitting on a Daly City bound train approaching the station, a female victim was approached by a man who told her to get out of her seat. When the woman stood up and began walking away, the suspect pushed the victim in the back. When the woman sat down at another seat, the suspect repeated his earlier demand and pushed the victim again after she exited the seat and began walking away. An officer detained the suspect at the Daly City station, where he was positively identified by the female and placed under citizen’s arrest for battery. The suspect was arrested for battery and issued a 30 day BART prohibition order.

The station agent called to report that he was in a fare dispute with an adult male.  During the dispute, the suspect was aggressively pointing at the agent and his finger struck the agent's nose.  Officers contacted the suspect and determined that he had a no bail warrant for battery and vandalism.  The male was placed under citizen's arrest by the agent for battery and fare evasion and was booked into the Redwood City Jail for those charges, as well as the warrant.  The male was also issued a prohibition order.

Balboa Park - 1308-4417

Patrons reported a female creating a disturbance on the platform.  The female suspect then began punching a female who was waiting for a train.  Officers from SFPD and BART arrived and had to use minimal force to take the suspect into custody.  The victim, who was apparently known to the suspect, suffered a scratch to her neck, an abrasion to her knee and a bite mark on her finger as a result of the attack.  The victim placed the suspect under citizen's arrest for battery.  The suspect had already been issued a prohibition order from a previous case, so she was cited for violation of that order and issued a new one.  She was then booked into the San Francisco County Jail for battery and resisting arrest.

 Possession of Narcotics for Sales/Prohibition Order Issued

MacArthur - 1308-4340

Officers responded to the station for a report of two men who were rifling through a large bag of possible stolen property while on the platform. Upon seeing the officers, the first suspect threw away a smaller bag from his pocket. Officers retrieved the bag, which contained approximately an ounce of possible narcotics that later tested positive for methamphetamine and a weigh scale. A search of the second suspect resulted in the recovery of a small amount of methamphetamine. The bag contained miscellaneous personal property that could not be verified as stolen because the financial institutions were closed. The first suspect was arrested for possession of narcotics for sales and was issued a 30 day BART prohibition order. The second suspect was placed under arrest for possession of narcotics. A sergeant arrived at the scene to approve the arrest and debrief the suspects. Both suspects gave interviews blaming the narcotics on the other, and claimed one of stolen credit cards was used to gamble at a nearby casino. The investigation of the possible stolen personal property items has been forwarded to detectives.

A witness reported a male and a female were in a verbal confrontation while at the bus stop. The subjects continued to argue as they made their way up to the platform to wait for a train. While on the platform, the witness saw the male hit the female in the face with his elbow and notified the police. An officer detained the male after the witness positively identified the man as the suspect. The man stated his girlfriend had scratched his face while they were arguing and he subsequently pushed her while on the platform. The male had scratch marks on his face and the female received visible injuries to her face, for which she declined medical assistance. Although the victim refused to make a citizen’s arrest or sign an emergency protective order (EPO), the male was deemed to be the dominant aggressor and was placed under arrest for domestic battery.A sergeant arrived at the scene to approve the arrest and debrief the suspect. A 30 day BART prohibition order was issued to the suspect.

ComSpec personnel monitoring the CCTV cameras reported seeing several suspects fighting on the platform.  Responding officers detained three adult suspects.  Their investigation determined that a male and female couple was fighting with a third male suspect.  There were no independent witnesses to establish the primary aggressor and the parties made cross-complaints.  All three suspects were issued citations for battery on a transit passenger,  All three were also issued prohibition orders and left the system.

Bay Fair - 1308-3757

An officer on patrol observed a female run into the station without processing a ticket.  The officer followed the female up to the platform where she had already boarded a train.  Upon contact the female refused to get off of the train.  Her boyfriend then came on to the train and told the officer that neither he nor his girlfriend were going to get off of the train because they were going home.  The female then got up and attempted to push pass the officer in an attempt to get away.  As the female approached the officer she threw her elbow striking the officer in the face.  The boyfriend attempted to intervene but was met by a second officer who had arrived on scene to assist.  The second officer had to physically restrain the male subject.  At this point the female continued to struggle and was attempting to get to the male to help him get free, but a citizen assisted the officer and subsequently placed her into handcuffs.  The male subject was also placed into handcuffs by the second officer.  Both the male and female were placed under arrest and taken to the sub-station.  A search incident to arrest on both parties revealed that the male was in possession of suspected contraband for sale.   A sergeant arrived at the scene to approve the arrests and debrief the suspects. The suspects were both issued a 30 day BART prohibition order.

An officer responded to a report of a man threatening a woman at the station. As the woman was asking for assistance, the male took her cell phone and pushed her to the ground while they were inside the station. Upon his arrival, the officer placed the suspect under arrest without incident. The subject was found to have been in violation of an active restraining order in which he was to remain at least 100 feet from the victim (who was also his ex-wife). The suspect was placed under arrest for violating a court order, domestic battery, and was issued a 30 day BART prohibition order. A sergeant arrived at the scene to approve the arrest and debrief the suspect. Video hotline notified.

A station agent witnessed a man piggyback to fare evade into the paid area. When the agent advised the man he needed to pay the proper fare to enter the paid area, the man pushed the station agent twice and walked downstairs to the platform. Officers were immediately on scene, and detained a person matching the description given. The suspect was positively identified by the station agent as the person who fare evaded and committed the battery. There were no injuries. The suspect was cited (per citizen’s arrest) for fare evasion, five outstanding traffic warrants out of San Francisco totaling $5,000, and placed under arrest for battery. A sergeant was on scene to approve the arrest and debrief the suspect. The suspect was issued a 30 day BART prohibition order.

 Criminal Threats/Possession of Altered Fare Media/Violation of Restraining Order

El Cerrito del Norte - 1308-2730

A sergeant and officers responded to the station and detained an adult male suspect who, on or about 8/18, had reportedly threatened to shoot the victim, who is his ex-girlfriend.  The victim, who is also a protected party in a restraining order against the suspect, positively identified the suspect at the scene.  A search incident to the arrest revealed the suspect was in possession of multiple BART tickets, many of which had a face value of zero and one of which was found to be altered.  Upon being placed in the police substation’s holding cell, the suspect became uncooperative and had to be physically restrained by officers.  The on scene sergeant approved the arrest, but was unable to debrief the suspect as he was very uncooperative.  The suspect was then transported to the Contra Costa County Jail, Martinez, where he was booked for criminal threats, altering fare media, and violating a restraining order.  He was also issued a prohibition order.  A lieutenant responded to the substation in order to perform the use of force investigation.  No injuries were sustained by police personnel, the suspect, or the victim.

Officers responded to the station on a report of a domestic disturbance. Upon arrival, they contacted a man and a woman arguing in a vehicle. Upon exiting the vehicle, the officer saw a switchblade in the male’s possession and placed him under arrest for possession of a dangerous weapon. A search of the suspect incident to arrest resulted in the recovery of another switchblade and a butterfly knife. The female stated the couple had gotten into an argument while in the vehicle, and the male pushed her out of the car. While in the police vehicle, the male began acting erratically and stated he had not taken his medication for anxiety in a few days. The male was deemed by the officers as a danger to himself, and paramedics were called to the scene for transportation to a psychiatric facility. When the officers opened the police vehicle door, the male became aggressive toward the officers and physical force was used to keep him inside the vehicle. When the paramedics attempted to strap him onto a gurney, the suspect kicked and attempted to bite one of the paramedics. A sergeant responded to the scene to approve the arrest and debrief the suspect. The suspect also complained of pain to his shoulder due to recent surgery, and was taken to the county hospital for treatment. After clearance from the hospital, the suspect will be have a psychiatric evaluation prior to being booked for possession of dangerous weapons, domestic battery, and battery upon medical personnel. The suspect was also issued a 30 day BART prohibition order. Video hotline notified.

Officers responded to a disturbance between two taxi drivers in the taxi cab zone. One of the parties made repeated threats of inflicting bodily harm to the other party in front of the officers. Because of his continuous threats of inflicting violence on the other party, the subject was placed under arrest for threatening another person. A sergeant arrived at the scene to approve the arrest and debrief the suspect. A 30 day BART prohibition order was issued to the suspect.

Patrons at MacArthur Station reported that a female suspect was in possession of a stun gun and that she claimed to have a gun in her backpack.  The suspect cursed at patrons and boarded a Millbrae bound train.  The suspect was described as a black female, 40-50 years old, wearing a yellow shirt and a black jacket.  The train was intercepted at 19th Street Station and a suspect matching the description was found.  The suspect attempted to walk away from officers and had to be physically restrained.  Officers located a stun gun wrapped in the woman's jacket.  She actively resisted being detained, but was finally taken into custody.  Based on her behavior and statements, officers determined that the woman was a danger to herself and others as the result of a mental illness.  She was detained for psychological evaluation.  One officer suffered minor injuries taking the suspect into custody.  The woman was transported to the hospital and once she is medically cleared, she will be booked for battery on a peace officer and resisting arrest.  No gun was found.  A prohibition order was issued.

An officer responded to a report of a person who spit on a station agent. Officers detained a person, who was later identified and placed under citizen’s arrest by the agent for battery. The suspect was placed under custodial arrest for battery, and also on an outstanding no-bail felony arrest warrant out of San Francisco for failing to register as a sex offender. A sergeant was on scene to approve the arrest and debrief the suspect. In addition, the suspect was issued a 30 day BART prohibition order.

A female victim reported that she was on a Dublin bound train when a subject masturbated in front of her.  The suspect then reportedly followed the victim onto the Coliseum platform when and grabbed her buttocks. An officer responded to the platform and detained a possible suspect.  The female victim positively identified the suspect during an in-field line up.  The detective sergeant responded to interview the suspect.   At the time of this posting, the suspect is to be issued a prohibition order and booked into the North County Jail for felony indecent exposure (the suspect had a prior conviction) and sexual battery.

Walnut Creek - 1307-2622/2552

A patron reported that there was a subject on a Millbrae bound train that was yelling and screaming racial slurs at patrons. The train was held at the Walnut Creek Station.  An officer responded and detained the suspect in question.  Further investigation into the matter revealed that the suspect was identified (via photo line-up) as the same suspect who battered both a station agent and patron and had also threatened to kill the same station agent on 07/20/13 at the Powell St. Station.  (Case number 1307-2552)  Officer Washington arrested the suspect based on the probable cause that existed for the criminal threats and the battery that occurred the day before and also issued the suspect a prohibition order. The suspect was also issued a citation for fare evasion.  A sergeant responded to debrief the suspect and approve the arrest.  The suspect was transported to the Lake Merritt Station where she was interviewed by the on-call detective.  The suspect was then transported to the SF County Jail where she was booked for criminal threats and battery on a passenger/station agent.  There was no complainant standing by for today’s disturbing the peace incident.

While walking to his vehicle, a victim was approached by two men who asked to use his cell phone. When the victim denied their requests, one of the men threatened the victim with bodily harm and kicked the victim’s vehicle several times as the victim tried to drive away. Officers detained the two suspects upon their arrival, one after a brief foot pursuit. The suspects were positively identified by the victim. One of the suspects was placed under arrest for challenging the victim to a fight and for vandalism, and was also given a 30 day BART prohibition order. The other suspect, a juvenile, was taken to the hospital for over intoxication. Upon release from the hospital, he will be cited and released to his parents for resisting arrest and for being in possession of alcohol. A sergeant arrived at the scene to approve the arrest.
