 Battery on Peace Officer (Prohibition Order Issued)

An officer responded to the station regarding a disturbance between the food vendor and a male subject. On arrival, the officer learned the subject had committed a petty theft and detained him. During the detention the officer attempted to place the subject in handcuffs but he physically resisted by grabbing the officer’s shirt - and a struggle ensued. At one point during the struggle, the subject managed to break free from the officer’s grasp but continued to exhibit aggressive behavior(s) toward the officer. The officer then deployed his Taser, ordered the subject to surrender, and he complied without further incident. The subject was arrested for battering the officer and resisting arrest; and a sergeant responded to approve the arrest and perform the use of force investigation. A wants/warrants check of the subject revealed he was on active probation for narcotics and auto theft violations, but was “clear” otherwise. The subject was issued a prohibition order before being booked into the county jail for battery on a peace officer, resisting arrest and probation violation; the vendor did not wish to pursue a criminal complaint against the subject. The officer suffered a minor injury, but did not require medical attention at the scene. The subject was not injured.

Investigators and ID technicians responded to conduct the investigation and process the scene. The coroner responded, began their investigation and removed the person from the trackway. The station was closed during the investigation, but trains were able to single track through the station on the other trackway. Service was restored at 1235 hours.

An anonymous patron reported seeing a subject place a gun inside his backpack and enter the station. Officers responded and entry into the station was temporarily suspended and trains were held out. The officers searched the platform level of the station and detained a subject who matched the description (Holmes, Aubrey, 4/30/78). The subject was taken into custody without incident and found to have a toy gun laying nearby on the platform. The subject was released after it was determined he committed no crime.

Psychiatric Evaluation

El Cerrito Plaza - 1501-0193

Officers responded to the station regarding the report by BART Central of a subject under a train on the San Francisco/Fremont track way. Power to both of the station’s track ways was shut down, and firefighters and paramedics responded as well. Eventually, the subject was located – apparently asleep – under the train. He finally awoke and made his way onto the platform; he was not injured. Shortly thereafter, the subject was transported to the county hospital for a psychiatric evaluation. As a result of the incident, train service into the station was interrupted for approximately 20 minutes. TSOC notified.

A victim was holding a phone in her hand and was standing at the bus stop on the east side of the station. A male suspect rode up on a black mountain bike, grabbed the victim's phone and rode off with the victim's phone. Loss was a white iPhone 4s (no serial number) and tracking software was not installed. The suspect was described as a Black male, 19-20 years old, goatee, green hoodie and jeans. The victim was not injured in this incident. An officer responded to search the area and completed a theft report. Station video was requested.
