Battery on Transportation Personnel (Prohibition Order Issued)

Sept. 4, 2017, 5:44 p.m.

19th St. Oakland
Case: 1709-0196

A male suspect who was reportedly causing a disturbance earlier, entered a restricted construction zone at the station. A (male) BART supervisor approached and warned the suspect, who then spit in the supervisor’s face and charged him. In response, the supervisor defended himself by striking the suspect about the mouth, and then restrained him until police arrived and took him into custody. The suspect, who was determined to be a danger to himself and others, was transported to a local hospital for medical care as he sustained a lacerated lip; after being medically cleared, he will be transported to the county’s mental health facility for psychiatric evaluation/detention. The supervisor, who was not injured, placed the suspect under citizen’s arrest for battery; the suspect was also issued a BART prohibition order. Once cleared from the psychiatric evaluation, the suspect will be booked into the county jail.
